One of the lawyers for Fiji's jailed vice president says his client was expecting a retrial and was extremely shocked by the Appeal Court's decision to dismiss his appeal.

Mehboob Raza, says Ratu Jope Seniloli's legal team will take the battle to free him to the Supreme Court.

The Appeal Court yesterday threw out Seniloli's appeal against his High Court conviction and four-year jail sentence for being sworn in as the usurper president during the coup.

Mr Raza says Seniloli was clearly shaken by the unanimous decision.

"He was, I mean for the first time I saw that he was very shaken up. Because throughout he heard the appeal as well and they all felt fairly confident that at least a retrial would be ordered. Naturally they're fairly down and out."

Mr Raza says they will lodge a further appeal with the Supreme court on the grounds of bias and abuse of process.

He says once they have sought leave to appeal they will file it within two weeks.
