Accused Fiji minister withdraws application to disqualify trial judge

6:33 am on 7 February 2005

Fiji's lands minister, Ratu Naiqama Lalabalavu, has withdrawn an application to disqualify magistrate, Sunil Singh, from continuing to hear his Labasa mutiny case.

Radio Fiji quotes his lawyer, Kitione Vuetaki, as saying they are unable to provide the standard of evidence required by the court.

Meanwhile, Ratu Naiqama's other application - for constitutional redress - will be heard early next month.

The minister is claiming that his constitutional right to a speedy trial has been breached because the case is continuing more than four years after the events in question took place.

Justice Jitendra Singh has ordered the minister to file supplementary affidavits to support his application.

Ratu Naiqama, government senator Ratu Josefa Dimuri, and two other Vanua Levu chiefs are facing a charge of illegal assembly for their role in the Labasa army mutiny during the Speight coup.
