Authorities in Fiji reportedly didn't tell the Australian consulate of gay sex offences committed by one its citizens until after he'd been convicted.

The Age newspaper reports an Australian government spokesman as saying Thomas Maxwell McCosker was denied legal advice because the Australian consulate wasn't told.

Thomas Maxwell McCosker and the Fiji man Dhirendra Nadan were each sentenced to two years' jail for indecent practices.

They've been released on bail pending an appeal hearing later this month.

A spokesman for the Australian Department of Foreign Affairs said yesterday that McCosker had been unfairly treated.
