American Samoa hospital keeps higher fees despite legal opinion

The LBJ Hospital in American Samoa has no plans at this time to change its fees, on the basis of a legal opinion.

The Senate legal counsel, Roy Hall Junior, says the hospital hasn't met the required procedures to effect the increase in charges.

Mr Hall has told the LBJ attorney David Cassetty that the new rates shouldn't be charged because the regulations haven't been formally adopted in accordance with administrative procedures.

Mr Hall says the authority may have to identify people that have paid the higher fees and offer them a refund.
