The board of directors for the LBJ Medical Centre in American Samoa has told the Senate it won't roll back new hospital fees introduced earlier this month.
The board insists their amendments were filed with the Fono.
Last week, the board attorney David Cassetty formally responded to a letter, signed by 17 senators, which asked the LBJ board to repeal the fees and issue refunds to the public.
The senators said this was because the regulations weren't properly filed according to the Administration Procedures Act.
Mr Cassetty says the the amendments were enacted properly and he personally delivered them to the Clerk of the House of Representatives.
