Two refugees who have been detained on Nauru have won the right to see the documents that outline why they were deemed national security risks.
The Australian newspaper, The Age, reports that lawyers for Mohammed Sagar and Muhammad Faisal have won the right to see the documents that outline their negative security assessments by the Australian Security Intelligence Organisation.
Both men were sent by Australia's Immigration officials to detention on Nauru in 2001.
While Mr Faisal was taken to Australia for psychiatric care in August, Mr Sagar remains on the island, uncertain of his future and reportedly also in a deteriorating mental state
But their lawyers say today's Federal Court victory is the first step in a legal battle aimed at overturning adverse security assessments of the men by ASIO, which have been maintained despite the Iraqis being declared genuine refugees.
The Nauru government has also expressed frustration that Mr Sagar has been there for five years without any resettlement option in sight, and has announced plans to charge Australia a penalty visa fee.
