Australian conman Peter Foster will remain behind bars in Vanuatu until at least Thursday, when a judge will rule on his bail application.
Foster is facing illegal entry charges after arriving near Port Vila last week on a boat that spirited the fugitive out of Fiji where he's wanted on fraud and immigration charges.
Police say Foster can expect a jail term and a steep fine if found guilty of illegally entering Vanuatu.
Vanuatu State Prosecutor Alfred Bice is seeking to have Foster remanded in custody for two weeks while an investigation continues.
Mr Bice says Foster could be prosecuted regarding his alleged crimes in Fiji if the documents are sent over.
"But at the moment we haven't got any documents. We've got the police here in Vanuatu negotiating with the police in Fiji to send the bail application that was done in Fiji and the charges which were laid against Peter in Fiji."
Alfred Bice says that if Foster is found guilty, they will push for his deportation back to Australia, not Fiji.
