PNG Supreme Court to rule on Highlands emergency

7:53 pm on 28 February 2007

The Papua New Guinea supreme court is expected to rule tomorrow morning on whether a state of emergency in Southern Highlands province remains in place.

It was first declared last August to suspend the provincial government of Hami Yawari, amid claims of widespread corruption.

But the state of emergency lapsed on Thursday last week, despite several attempts by the government to get the numbers in parliament to extend it.

Control of the province then returned to Mr Yawari and his administration.

The cabinet subsequently issued an order to re-establish the state of emergency but this was challenged in the courts by Mr Yawari, who called for a judicial review, saying parliament is the supreme law making body and cabinet could not override it.

The Supreme Court is expected to announce its decision on his request tomorrow.

Meanwhile, parliament was adjourned today until April 17th, with no vote held on the Southern Highlands issue.

Our correspondent says some MPs have raised doubts about the value of the emergency.
