High Court in American Samoa wants government to pay court approved settlment

The High Court in American Samoa is calling for the governor to secure funding from the Fono to pay a court approved settlement.

Last year, the court approved an out of court settlement in a lawsuit filed against the government and the LBJ Hospital.

The suit was filed by Leasuasu Tupuono whose wife died following the delivery of twins.

The plaintiff claimed that the negligence of LBJ's staff caused his wife's death.

The parties agreed to settle for 160,000 US dollars, but up to now the government has not paid.

The plaintiff petitioned the court to have the LBJ Hospital pay the settlement directly since it is an independent agency.

But the court said the LBJ Hospital is not a properly named defendant in the lawsuit and that government is responsible for paying the settlement.
