Qarase challenge to his government's overthrow to open in court today

11:32 am on 4 October 2007

Three senior Fiji judges are to preside over the case brought by the deposed Fiji prime minister, Laisenia Qarase, challenging the overthrow of his government in the December 5th military takeover.

Radio Legend reports that they are the acting chief justice, Anthony Gates, Justice John Byrne and Justice Devendra Pathik.

The radio report says the judges will sit as members of Fiji's Supreme Court.

The hearing is to get under way in Suva today but Mr Qarase's Australian lawyer, Stephen Gagler QC, could not arrive because of other engagements.

Instead, another Australian lawyer, Nye Perran QC, and Rachael Pepper will be assisting Mr Qarase's local lawyer, Tevita Fa.

The interim administration has also brought in overseas lawyers at a reported cost of 165-thousand US dollars.

The new president of the Fiji Law Society, Isireli Fa, says he will meet with the interim attorney general to persuade the state to use the services of local lawyers who, he says, have the required expertise.
