The police in Fiji will be asked to justify their detention of a New Zealand man who's been in custody for his alleged involvement in a plot to kill the interim prime minister.

Ballu Khan is in hospital recovering from injuries sustained during his arrest in November.

His lawyer, Peter Williams QC, says a hearing at the High Court in Suva on Monday will determine whether Mr Khan can be further held without charge.

Mr Williams says his client has been detained for almost two months, and if the police can't justify their actions the judge can order his immediate release.
