The American Samoa insurance company, Progressive Insurance has petitioned the court to order the governor to pay the $6.6 million judgment for the Laufou Shopping Centre fire.
A petition for extraordinary relief filed by the insurance company asks the court for an order to compel Governor Togiola Tulafono to send legislation to the Fono at its next session requiring payment of the judgment plus post judgment interest of 6% .
On July 24 last year the high Court ruled that the American Samoa Government was liable for damages from the fire due to several acts of negligence by fire department employees and issued a judgment in favor of Progressive.
