Samoa speaker won't rely on AG in Tautua Samoa Party case

Samoa's parliamentary speaker will be represented by a private law firm of his choice in the legal action by the Tautua Samoa party against his ruling

to disqualify all nine MPs of the new political party for breaching the Electoral Act.

The Attorney General, Aumua Ming Leung Wai, won't represent the speaker because according to a reliable source the AG disagrees with the speaker's interpretation of the law relating to the disqualification of the nine party members.

This has come after the speaker had sought the Attorney General's advice.

However, the speaker has also sought legal advice from other local private law firms.

A former politician says the difference of legal interpretations of the Electoral Act on the establishment of political parties shows the separation of powers between Parliament which is the prerogative of the speaker, and the Executive where the Attorney General's office is part of as the legal advisor to the government.

The legal action has been filed and expected to be called for mention in the Supreme Court this week.
