Court's decision in Moti appeal case reserved

A judge has reserved his decision on whether subpoenas against two Australian Government agencies issued by former Solomon Islands attorney-general Julian Moti should be set aside.

Mr Moti, through his lawyers, issued the subpoenas against the Australian Federal Police and the Department of Foreign Affairs and Trade, seeking disclosure of information on his deportation from the Solomons two years ago.

He claims the agencies acted unlawfully.

The subpoenas were issued as part of Moti's bid to have seven charges - which relate to the alleged rape of a 13-year-old girl in Noumea and Vanuatu in 1997 - dropped.

"In the Brisbane Supreme Court yesterday (thursday) , lawyers for the AFP and DFAT applied for Justice Glenn Martin to set the subpoenas aside."
