All Black Aaron Smith's career is once again in question, with the Rugby Union saying it has hired a lawyer to look into claims he lied about a tryst with a woman in an airport toilet last year.
Employment law specialist Peter Cullen says if it's deemed serious misconduct, it does not necessarily set grounds for dismissal.
