High Court to hear Bathurst case

Bathurst Resources says an appeal against a climate change declaration will be heard in the High Court at the end of the month, after failing to have the matter sent directly to the Court of Appeal.

The company, which is based in Perth, wants to develop an open cast coal mine on the West Coast, but is facing opposition from environmental groups after securing resource consents.

In May, the court rejected arguments by environmentalists that climate change should be considered by councils in determining whether or not to grant resource consents.

Bathurst says the current appeal does not affect the timing of an Environment Court case in October, which will consider the original appeal against the resource consents.
