Earthquake Recovery Minister Gerry Brownlee says he's confused by a Court of Appeal decision confirming he acted unlawfully in seeking to fast-track a housing development in Kaiapoi, near Christchurch.
The Court of Appeal has upheld a High Court ruling relating to a legal challenge to the special powers Gerry Brownlee was given under the Earthquake Recovery Act.
The High Court said the Minister acted outside his emergency powers to push through the development.
Mr Brownlee appealed against that decision, but the Court of Appeal said he should have explored other avenues allowing for more community consultation.
Mr Brownlee said he did consider those avenues, as outlined in his affidavit.
He said he is disappointed the Court of Appeal didn't contact him to seek clarification.
The minister said he needs to consult with his legal team before making comment on any further action he might take.
