Court rejects health funding discrimination claim

The Court of Appeal has thrown out the case of a wheelchair user with multiple sclerosis who says government funding is discriminatory.

Melanie Trevithick argues she would get greater financial support from the Accident Compensation Corporation (ACC) than she currently receives from the Ministry of Health, if her disability was caused by an accident, and not an illness.

The Human Rights Tribunal and the High Court had already rejected the claim, saying discrimination on the cause of a disability is not unlawful.

The Court of Appeal found that discrimination could be justified, because of the way the ACC scheme is designed to operate.
