Court reverses decision to strike off GP

A Hamilton GP has been given until 2 July to make submissions to the High Court or his deregistration as a doctor stands.

In April 2011, Suresh Vatsyayann was struck off by the Health Practitioners Disciplinary Tribunal for professional misconduct, but appealed against the decision in March this year and the court has ruled partially in his favour.

Dr Vatsyayann was deregistered for enrolling patients without their consent, breaching patient privacy and allowing his unqualified wife to perform procedures such as smear tests.

The Hamilton High Court upheld the charges, but ruled that he did not have an opportunity to present any mitigating factors to the tribunal and that the tribunal should revisit the penalty.

No date for a new hearing has yet been set, as it depends on whether the submissions are received in time.
