RSA attack case not to be heard by jury

The sole survivor of a fatal attack at the Mt Wellington-Panmure RSA, who is suing the Department of Corrections, has been told the case won't be heard by a jury.

Susan Couch was gravely injured during the attack by William Bell in 2001

Ms Couch is suing the Attorney-General for $500,000 on the grounds that Bell was on parole at the time she was injured.

She had asked for a jury to hear the case, but a High Court judge in Auckland has rejected the request saying the legalities would be unreasonably complicated for a jury.
