RSA attack victim to appeal against ruling on jury

The sole survivor of a fatal attack at the Mt Wellington-Panmure RSA is appealing against a decision to hear her compensation bid before a judge only.

Susan Couch was gravely injured during the attack by William Bell in 2001.

Ms Couch is suing the Attorney General on behalf of the Department of Correction for $500,000, because Bell was on parole at the time she was injured.

Last month a High Court judge rejected a request for her case to be heard before a jury.

Her lawyer, Brian Henry, says he has filed papers with the Court of Appeal.

The judge-only trial is set down for June next year.
