Drug charge against gang member stayed

A drug charge against a former high-ranking gang member has been stopped by the courts because of breaches by police.

Phillip Schubert, who used to be president of Hells Angels Auckland, has had a charge of offering to supply methamphetamine stayed in the Auckland High Court due to serious police breaches during an undercover operation in Nelson.

Mr Schubert was arrested during Operation Explorer, aimed at cracking the Red Devils Gang, where police faked the arrest and prosecution of an undercover officer.

Last week, a judge dismissed charges against 21 of the Red Devils gang members, ruling that police had deceived the courts.

The prosecution against Mr Schubert was the third to be dropped because of the police operation.

Mr Schubert says he feels he has been targeted by police and will look at seeking costs from the Crown in the tens of thousands of dollars.

The Crown Law Office is considering an appeal.
