The Crown is appealing against a High Court decision to grant a stay of proceedings to members of the Red Devils motorcycle club.
Serious charges against 21 people in Nelson were stayed last week because police tried to falsely prosecute an undercover officer.
A spokesperson for the Solicitor-General says they have questioned Justice France about that decision.
The spokesperson says Justice France will now decide whether to allow them to go to the Court of Appeal.
