The Supreme Court has decided it will hear more legal argument from David Bain's defence team before a scheduled retrial.
Mr Bain's retrial on charges of murdering his parents and three sibilings is due to start on 2 March.
His defence team is fighting at a stay hearing in Christchurch this week to have all charges dropped.
The team has also been granted an appearance before the Supreme Court on Monday, on a different matter.
The timing of the legal argument may cause difficulties for the court if there are no decisions on either hearing before 2 March, which could mean the retrial's start date will have to be re-negotiated.
Both matters relate to evidence that may be heard in the retrial, however all details are suppressed.
