Decision reserved in MFAT leak case

A little more detail has emerged about the person at the centre of an inquiry into the leak of documents on the Ministry of Foreign Affairs and Trade restructuring to the Labour Party.

The Court of Appeal on Tuesday heard arguments from a lawyer for 'person A' that his client's identity should remain secret.

In her draft report for the State Services Commission, Paula Rebstock says she has strong suspicions that person A may have been responsible for the leak.

Suppression orders are in place to protect their identity, but the Appeal Court said it could be reported that they were a clerical assistant.

Deputy Solicitor-General Una Jagose told the court that the State Services Commissioner wishes to make the final report public but would not name the person.

Jason McHerron, the lawyer for person A, said the final report should deal with the facts - not Ms Rebstock's suspicions.

Judge Mark O'Regan told him that Ms Rebstock had ample evidence to make the finding she made.

The court has reserved its decision.
