Court throws out Brown prosecution

An attempted private prosecution of Auckland mayor Len Brown has been rejected in the Auckland District Court.

Wellington man Graham McCready had taken the prosecution, accusing the mayor of corruption because he accepted free hotel rooms and upgrades from SkyCity that he failed to declare.

Auckland District Court judge Ema Aitken on Friday rejected the prosecution because Mr McCready had not sought leave of the Attorney-General, which must be done to prosecute any official under the Crimes Act.

Mr McCready said he will make an application to the Attorney-General and refile prosecution papers if it is accepted.
