A director of a failed finance company has been back in court charged with breaching his home detention conditions.
Anthony Banbrook was a director of National Finance which went into receivership in 2006 owing 2000 investors more than $24 million.
Banbrook was sentenced to eight-and-a-half months' home detention, to be served at his million dollar North Shore home, for distributing a registered prospectus containing untrue statements.
He was allowed to leave his house after 9am for his work as a lawyer.
He told the North Shore District Court today that he rang the Corrections Department and left a message on their phone after finding out that he had to be in the High Court at 9am.
Mr Banbrook has described the prosecution as "pathetic and spiteful" and says he will defend the charge.
Since it was laid, he has been suspended from practising for seven months by the Lawyers and Conveyances Disciplinary Tribunal after it was found his conviction had brought the legal profession into disrepute.
