The Earthquake Commission and the insurer Southern Response have been accused of ignoring their own experts and cherry picking alternative theories on the damage caused to a house in order to help their case.
Cameron and Suzy Kelly are challenging both insurers over their decision to carry out limited repairs of their quake damaged home instead of rebuilding it.
They say it should be paying to have the house rebuilt at a cost of $525,000.
Summing up in the High Court in Christchurch today, the couple's lawyer Grant Shand said the ten experts the insurers originally hired to assess the house all agreed the foundations needed replacing.
He said the insurers subsequently hired a second group of experts to say the house was largely unscathed.
Mr Shand said it was telling that none of these experts were called as witnesses for the defendants.
