Lawyer seeks to have Fiji conspiracy case thrown out

The lawyer for a New Zealand man accused of plotting against Fiji's interim prime minister is to begin his High Court battle to have the case thrown out.

Ballu Khan and 10 others have been charged with conspiracy to kill Commodore Frank Bainimarama and other cabinet members.

Mr Khan's lawyer, Peter Williams, QC, will ask the Fiji High Court on Monday to dismiss the three charges against him.

He says the state has destroyed relevant documents and the mainly military officials have failed to disclose evidence to Mr Khan.

Mr Williams says the officials are also guilty of criminal assault.
