Boy killed in crash didn't have seatbelt on, court told

There was no sign that a boy who died following a Wairarapa car crash had been wearing a seatbelt, a Wellington jury has been told.

Wendy-May Connon, 40, is charged with with failing to take reasonable care while driving, causing the death of her four-year-old son Konrad Truger in January 2008.

She has pleaded not guilty to the charge of manslaughter and is being tried at the High Court in Wellington.

The Crown alleges Ms Connon was speeding and had smoked cannabis before the crash near Featherston in south Wairarapa.

On Tuesday, the court heard a statement from paramedic Lisa Taylor who attended the crash scene and worked on Konrad Truger.

Ms Taylor said the boy was lying unconscious about 50 metres from the car and had a fractured femur, an abrasion on his face and a fixed and dilated pupil.

Ms Taylor said usually, even in a minor accident, a seatbelt or restraint would leave a mark on a shoulder.

However, she saw no such sign on Konrad Truger, nor any mark across him such as a lap belt would make.

Earlier, farmer Timothy Campbell told the court he found the boy's body 30 metres away from the car.

Mr Campbell said he saw a car rapidly approaching behind him and then it overtook him. Some time later, he said he came upon the crash scene and saw the driver lying against an electric fence.

Mr Campbell said he twice got on his hands and knees to see if anyone was under the car and later he found the boy's body in the paddock.

On Monday, the court heard from a six-year-old passenger who said he told Ms Connon to slow down before she crashed.

In evidence given via a police video recording, the boy told the the jury Ms Connon did not listen to his plea and that he was annoyed with her.

The trial is expected to take up to two weeks. The jury of seven women and five men will visit the scene of the crash.
