Three Lower Hutt women are going to court for a fourth time seeking to stay in state houses.
They and two others were served with eviction notices in March by Housing New Zealand after a spate of intimidation complaints in the suburb of Pomare.
The three are partners of Mongrel Mob members.
Lawyer Elizabeth Hall says they cannot be forced to leave while the court case is ongoing.
She says papers have been filed with the Court of Appeal and there will be a hearing next week seeking permission for the appeal to go ahead.
In the meantime, she says the High Court has ordered there be no evictions until the appeal issue is decided.
