Wellington City Council says ratepayers will not have to foot a $5 million bill to repair the city's leaky stadium.
Westpac Stadium Trust has launched legal action against the stadium's builders, Fletcher Construction, for $4.86 million in damages because of a leaking roof and deteriorating cladding.
A city councillor and Westpac Stadium board member, John Morrisson, says a legal claim had to be made before the 10-year period for court action expired.
He says he hopes an agreement can be reached without going to court, and without ratepayer funds.
Fletcher Construction says liability does not fully rest with it to repair the faults.
Spokesperson Philip King says as the stadium is now 10-years-old, it is difficult to determine who is responsible.
Mr King says the company hopes to resolve the dispute outside court.
