9:56 am on 21 July 2010

The Department of Labour has laid charges in relation to an incident in which a Vietnamese tourist was killed after two wheels came loose from a truck on the southern motorway in Auckland on 14 January.

One of the wheels bounced into the path of an oncoming bus injuring a passenger who later died in hospital. Three other people were moderately injured.

The death has been referred to the coroner.

Police say an extensive investigation found there was no criminal case to answer.

They referred the matter to the Department of Labour which has now laid charges under the Health and Safety in Employment Act.

The department won't comment further until the case is heard in the Pukekohe District Court on 18 August.
