Decision reserved in state-house eviction case

The future remains unclear for three Lower Hutt women who again took their state-house eviction fight to court on Monday.

The trio, who have Mongrel Mob links, were served with 90-day eviction notices in March last year after a spate of gang intimidation.

The Tenancy Tribunal, as well as a district court and the High Court, have upheld Housing New Zealand's right to end the tenancies.

Lawyers from both sides, as well as for the Attorney-General and the Human Rights Commission, argued the case in the Court of Appeal on Monday.

The women's lawyer, Elizabeth Hall, said the eviction notices are discriminatory and were triggered by the actions of their partners. Her clients want the case sent back to the Tenancy Tribunal, which Ms Hall says is the most appropriate place for it to be decided.

The three presiding judges reserved their decision.
