Leaky building case goes to Supreme Court

12:09 pm on 8 November 2010

Two leaky building cases relating to properties on Auckland's North Shore are being heard by the Supreme Court on Monday.

Body corporates for the apartments are suing the former North Shore City Council.

One of the issues in the case is whether the council owed a duty of care to apartment purchasers to ensure that the buildings complied with the building code.

If the court rules in favour of the apartment owners, any liability will be picked up by the new Auckland Council.

The court is likely to reserve its decision.
