Old council's appeals over leaky homes dismissed

The Supreme Court has dismissed appeals by the former North Shore City Council relating to leaky homes.

Apartment owners had sued the former council.

But the council appealed against two Court of Appeal rulings that it was liable for any loss caused by negligent inspection.

The Supreme Court has upheld that decision, agreeing the former council did owe a duty of care to the owners to ensure the buildings complied with the building code.

Any liability will be now have to be picked up by the Auckland Council.
