Killer to be released on parole

Convicted killer David Bourke is to be released from prison on parole.

In October 2009, Bourke eluded armed police for 40 hours before being arrested in southern Hawke's Bay.

At his trial late last year, he was acquitted of murdering his brother but found guilty of manslaughter and sentenced to a term of two years and 10 months in prison.

Bourke's lawyers argued that his suicidal brother had provoked him into a fatal shooting.

Bourke is now 48 and the Parole Board says he poses a medium to low risk of reoffending.

Judge Carruthers says he is satisfied Bourke can be managed safely in the community without undue risk.

He will be released in May, but is banned from using alcohol and drugs or possessing firearms and ammunition.
