Appeal by killer of Auckland teen fails

The Court of Appeal has dismissed a challenge against a man's conviction for murdering an Auckland college student.

Augustine Borrell, 17, was stabbed to death after a party in Herne Bay in 2007.

Haiden Davis was eventually found guilty of the murder. He had been on bail for another violent crime at the time.

Earlier this year, Davis' lawyer argued there had been a number of problems with the way the trial was conducted including instructions from the trial judge to the jury.

The Court of Appeal on Thursday said it had dismissed the bid on all grounds.
