Alleged spammer faces more court action

The Department of Internal Affairs is taking further High Court action against an alleged online spammer which has already been issued a formal warning for breaching Australia's anti-spam laws.

The department is seeking financial penalties of $500,000 against Image Marketing Group, and $200,000 against its director, Brendan Battles.

The third in a series of claims against the company comes after it marketed a database of 50,000 email addresses through an unsolicited electronic message.

A New Zealand businessman purchased it, believing it to be a legitimate database to which business had signed up. He then received 400 complaints.

The department says appropriate consent is required before sending any commercial electronic messages, and some businesses which bought the databases have been investigated and fined.
