Supreme Court hearing leaky building case

1:16 pm on 1 November 2011

A Supreme Court hearing has begun in Wellington relating to a leaky building development on Auckland's North Shore.

The leaks in the Grange development arose from the use of face-fixed monolithic cladding over untreated timber framing.

The body corporate and the individual unit owners have sued various defendants involved in the development, including the North Shore City Council.

In July last year the Court of Appeal ruled that the Building Industry Authority could not be brought into the court action as a third party.

Tuesday's case is an attempt by the North Shore City Council to overturn that decision. The council says the Building Industry Authority owed a duty of care to the council, the body corporate and the unit owners.
