Relativity clause will be triggered by Tuhoe settlement

11:15 pm on 12 September 2012

Treaty Negotiations Minister Chris Finlayson says once the deed of settlement with Ngai Tuhoe is signed it will trigger a legal clause giving more money to Ngai Tahu and Tainui.

If the value of all Treaty settlements ends up being more than $1 billion, then the relativity clause will kick in - providing the two iwi with a top-up payment which could total millions of dollars.

That clause was set up in 1995 so that the position of the iwi was maintained relative to others that settle their claims in later years.

Mr Finlayson says the size of the top-up will depend on what the total figure for claims works out to be.
