The Prime Minister says the Ministry of Social Development will receive the best legal advice possible so it can decide how to plead on a charge over last year's Ashburton Work and Income shootings.

WorkSafe yesterday laid a charge against the ministry of failing to take all practicable steps to ensure the safety of its staff at the office last year.

John Key said WorkSafe was an independent body and must act as such when considering a prosecution.

Mr Key said WorkSafe had now taken legal action against the Government in four cases, all involving fatalities.

Two Work and Income employees were killed, and another was injured, when a gunman opened fire in the office in Ashburton in September 2014.
