The Green Party has missed out on fielding a candidate in the Botany by-election next month because the paper work reached the returning officer too late.
One of two nomination forms for Green Party candidate Richard Leckinger was ruled invalid because the signatory was found to have moved outside the Botany electorate.
Mr Leckinger says a replacement form reached the returning officer two minutes after the 12pm deadline.
He says it was unfortunate that traffic congestion meant he could not get there in time and he feels bad about letting down his supporters.
However Mr Leckinger says he accepts the returning officer had to abide by the rules.
The by-election on 5 March was caused by the resignation of National Party MP Pansy Wong, who stepped down last year over the misuse of her international travel subsidy.
