Legislation amending Crimes Act introduced

Justice Minister Simon Power has introduced legislation that amends parts of the Crimes Act.

Under the legislation the Claim of Right defence, used by the three men who attacked the Waihopai spybase in 2008, will be amended so anyone using it must believe they have a personal right to the property concerned.

The Crimes Amendment Bill (No 2) also creates a new offence of failure to protect a child or vulnerable adult from the risk of death, grievous bodily harm, or sexual assault.

It also doubles the maximum penalty for cruelty to a child from five years to 10 years' imprisonment, amends the offence of sexual grooming and increases the maximum penalty for possession of an offensive weapon.
