ACT wants Crimes Act to include right to self-defence

The ACT Party wants several sections of the Crimes Act changed to include a right to self-defence for people and their properties.

Although still to be released, party leader Don Brash outlined its planned policy at a public meeting in Auckland on Sunday.

Dr Brash says the Crimes Act should be amended to include a presumption of immunity from prosecution for people who use reasonable force to defend themselves or their property.

He says he would delete the words "if he does not strike or do bodily harm to that person" from section 56 of the act in relation to defending land or property.

Dr Brash says if trespassers turn violent, it is entirely possible any reasonable force to evict them would involve striking them or causing bodily harm.
