University building strength appeal dismissed

The Court of Appeal has dismissed an application by the University of Canterbury to appeal against a ruling on building strength.

In October, the court ruled that Christchurch City Council did not have the power to ask property owners to strengthen existing buildings up to 67% of the national building standard.

The university challenged the decision and appealed against the ruling on the grounds the court either failed to address a substantive argument that was put to it, or mis-stated or misunderstood the university's argument.

In a ruling released on Wednesday, the Court of Appeal called the university's application misconceived, saying it is only trying to re-argue and challenge the substantive grounds for the Court's decision.
