Mother upset at judge's ruling

A mother has told a court she is devastated that her former partner has been discharged without conviction for the second time.

The man, a Tauranga professional with permanent name suppression, was charged with breaching family and protection orders.

He was excused from attending the Auckland District Court today for Judge Phil Recordon's judgement.

The judge said it was a balancing exercise and difficult.

The court was told the man sent his son a book with a message in it and his contact details, despite being the subject of a protection order at the time that forbade him any contact with his son.

The man has also been discharged without conviction for assaulting the boy.

The woman says she is devastated by the decision and has lost faith in the justice system.
