The Kiwis captain Benji Marshall will face a court hearing in August over a charge of assaulting a man at a McDonald's restaurant in Sydney.

The Wests Tigers National Rugby League player didn't appear in court on Friday, when the three-day hearing was scheduled.

Marshall's accused of assaulting Soliman Naimey, occasioning actual bodily harm.

He is alleged to have attacked the man in the early hours of the morning at the fast food outlet in March.

His lawyer, John Byrnes, said 14 witnesses would appear for the prosecution, and up to four for the defence.

A not guilty plea was entered on Marshall's behalf in April.
