Hate speech trial in South Africa

1:00 pm on 12 April 2011

The trial is underway in South Africa of an African National Congress youth party leader charged for singing a song that has been deemed to promote hate.

Julius Milema performed the song during an ANC rally in defiance of an earlier court ruling that reference in the lyrics to 'kill the Boer' constituted hate speech.

The ABC reports he claims it came from the anti-apartheid struggle.

The ANC has called the court's original ruling unreasonable and says the offending phrase is metaphorical and needs to be viewed in an historical context.

The AFRA-FORUM white lobby group has now taken the case to court saying the words of the song are incendiary and divisive.
