The President of the Marshall Islands, Kessai Note, has not accepted a letter of resignation submitted by the Supreme Court Chief Justice, Allen Field.
His resignation was submitted after he was charged in California with soliciting a lewd act and indecent exposure.
In a newspaper interview last week, Mr Field denied the charges.
The Marshalls Justice Minister, Witten Philippo, says the government is taking a wait-and-see attitude to the case.
